An appeal to overturn the Monmouth County Board of Elections’ nullification of mail in ballots in the Asbury Park Board of Education was dismissed on Monday in Freehold.
Board Member Nicole Harris appealed the rejection of 41 mail in ballots by the Monmouth County Board of Election following the election in April.
Harris lost by a slim margin to Dominic Latorraca, who was third in line for the three available seats when the ballots were counted.
Harris asked for a recount and when that did not change the results, she appealed the court’s decision.
Board Member Barbara Lesinski, who ran with Latorraca and was elected in April said, “I was happy that the judge upheld the county board of election’s decision to nullify some of the ballots that came in by mail.”
Lesinski said Harris would have needed 28 of the votes to be eligible in order to force a run off election between her and Latorraca.
